Terms of Service

1. Agreement to Terms

By accessing or using CODEVANISH ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

CODEVANISH provides code obfuscation and protection services for software developers, including but not limited to JavaScript, TypeScript, Python, Java, C#, and trading platform code (NinjaTrader 8, MetaTrader 4/5, TradingView Pine Script).

2. User Accounts

2.1 Account Creation

To use certain features of the Service, you must create an account using GitHub OAuth or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Account Responsibilities

• You must provide accurate, current, and complete information during registration
• You must be at least 18 years old to use this Service
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access or security breach
• One account per person; no account sharing is permitted

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate, with or without notice.

3. Acceptable Use Policy

You agree NOT to use the Service to:

• Obfuscate malicious code, malware, viruses, ransomware, or any harmful software
• Violate any applicable laws, regulations, or third-party rights
• Infringe upon intellectual property rights of others
• Upload code you do not own or have permission to obfuscate
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service for illegal activities including fraud, theft, or unauthorized access
• Abuse, harass, or harm other users or our staff
• Create multiple accounts to circumvent usage limits
• Resell or redistribute our Service without written permission
• Use automated systems to abuse the Service or exceed rate limits

Violation of this policy may result in immediate account termination and legal action.

4. Intellectual Property

4.1 Your Content

You retain all ownership rights to your source code. By using our Service, you grant us a limited license to process, obfuscate, and store your code solely for the purpose of providing the Service. We do not claim ownership of your code.

4.2 Our Service

The Service, including all software, algorithms, designs, text, graphics, and other content, is owned by CODEVANISH and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

4.3 Obfuscated Output

The obfuscated code generated by our Service is your property. You may use it for any lawful purpose, including commercial distribution, without attribution to CODEVANISH.

5. Subscription Plans and Payments

5.1 Plan Tiers

• Free Plan: 10 obfuscations per month, basic obfuscation level
• Pro Plan ($5/month): 100 obfuscations per month, all obfuscation levels, priority processing
• Unlimited Plan ($50/month): Unlimited obfuscations, all features, REST API access, highest priority

5.2 Billing

Paid subscriptions are billed monthly in advance via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in USD and non-refundable except as required by law.

5.3 Usage Limits

Usage limits reset on the first day of each billing cycle. Unused obfuscations do not roll over to the next month. If you exceed your plan's limits, you must upgrade to continue using the Service.

5.4 Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated at least 30 days in advance and will apply to subsequent billing cycles. Continuing to use the Service after a price change constitutes acceptance.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellations take effect at the end of the current billing period. You will retain access to paid features until the end of the billing period.

6.2 Refund Policy

All payments are non-refundable except:

• Service outages lasting more than 48 hours (pro-rated refund)
• Billing errors or duplicate charges
• As required by applicable law

Refund requests must be submitted within 7 days of the charge. We do not provide refunds for partial months or unused obfuscations.

7. Service Availability and Support

7.1 Service Level

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Service. We may suspend the Service for maintenance, updates, or security reasons with reasonable notice when possible.

7.2 Support

• Free Plan: Community support (forums, documentation)
• Pro Plan: Email support with 48-hour response time
• Unlimited Plan: Priority email support with 24-hour response time

7.3 Data Retention

Your source code is processed in memory and deleted immediately after obfuscation. We retain obfuscated output for 30 days for download purposes, after which it is permanently deleted. Account data is retained as described in our Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The obfuscation will be 100% unbreakable or irreversible
• The Service will be error-free, secure, or uninterrupted
• The results will be accurate or reliable
• Any defects will be corrected

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODEVANISH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

8.3 Security Disclaimer

While our obfuscation techniques are designed to protect your code, no obfuscation method is completely unbreakable. Determined attackers with sufficient time and resources may be able to reverse engineer obfuscated code. We are not responsible for any security breaches, reverse engineering, or unauthorized access to your obfuscated code.

9. Indemnification

You agree to indemnify, defend, and hold harmless CODEVANISH, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights, including intellectual property rights
• Your use or misuse of the Service
• Any code you upload or obfuscate through the Service

10. Third-Party Services

Our Service integrates with third-party services including:

• GitHub: OAuth authentication and repository access
• Google: OAuth authentication
• Stripe: Payment processing

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or actions of these third-party services.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

11.2 Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.

11.3 Exceptions

Either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm. Small claims court actions are exempt from the arbitration requirement.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and may cancel your subscription.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CODEVANISH regarding the Service and supersede all prior agreements, understandings, and communications.
